Terms of Service

  1. Chapter 1 General
    1. Article 1 (Purpose)

      The purpose of these terms of services is to set forth the conditions of use, procedures, rules applicable for the members, and other necessary issues for using weidong.com, which is a service provided by Weidong Ferry Co., Ltd. (hereinafter referred to as Weidong Ferry).

    2. Article 2 (Effectiveness and Amendment of the Terms of Service)
      1. 1. The contents of the terms of service take effect when displayed on the service screen or notified to the members using other means.
      2. 2. Weidong Ferry is entitled to make amendments to these terms of services. The revised provisions shall take effect upon notification as set forth in Item 1 above.
    3. Article 3 (Supplementary Rules of the Terms of Services)

      Any issues not specified herein shall be governed by the Basic Act on Electric Communication, Act on Electric Communication Business, and other related laws and regulations.

    4. Article 4 (Definition)
      1. 1. The following terms used in these terms of service shall be interpreted as below;
        1. 1) Member: an individual who entered into the service contract with Weidong Ferry.
        2. 2) ID: a combination of characters and numbers designated by the member and approved by Weidong Ferry in order to verify the identification of the member and the member’s use of the services.
        3. 3) E-mail: the internet mail account of the member.
        4. 4) Password: a combination of characters and numbers designated by the user in order to confirm that the member corresponds matching with the ID assigned to the user and to protect the secrets of the member.
        5. 5) Administrator: an individual designated by Weidong Ferry in order to conduct the overall management of the services and execute operations related to these services in a seamless manner.
        6. 6) Termination: termination of the service contract after initiation of the service either by Weidong Ferry or by the member.
  2. Chapter 2 Signing Up and Using the Services
    1. Article 1 (Effectiveness of the Service Agreement)
      1. 1. The service contract takes effect upon the application by the user to use the service, Weidong Ferry’s acceptance of the application, and the consent given by the user to the terms of service.
      2. 2. An applicant who wishes to use the services by signing up as a member is required to provide the personal information requested by Weidong Ferry.
      3. 3. Weidong Ferry may refuse to grant the acceptance of the application for the service agreement in any of the following cases.
        1. 1) If the applicant is under 14 years old.
        2. 2) The name provided by the user is not a real name.
        3. 3) The applicant assumes someone else’s name.
        4. 4) The applicant made a false statement in relation to the required information.
        5. 5) The applicant made the application with the aim of doing harm or violating acceptable norms of social behavior and practice.
        6. 6) Other required conditions to use the services set forth by Weidong Ferry are not met.
    2. Article 2 (Amendment of the Contract Information)

      A member should make amendment(s) to the information provided at the time of application to use the service if there are any changes with regard to such information.

  3. Chapter 3 Use of the Service
    1. Article 1 (Service Hours)
      1. 1. The service herein is available 24 hours a day, in principle, unless Weidong Ferry experiences operational or technical difficulties. In addition, the service may not be available during regular system checks, website upgrades, or other times as designated by Weidong Ferry.
      2. 2. Weidong Ferry may divide the services into different schedules and set the available hours for each section of the services. In such a case, the service hours of such segmented services shall not be announced in advance.
    2. Article 2 (The obligations on the management of the user’s ID, e-mail, and password)
      1. 1. The responsibility of managing the ID, e-mail, and password is with the member. The members shall take full responsibilities for any consequences of his/her neglecting the duties of managing or refraining from misusing the ID, e-mail, or password.
      2. 2. If a member finds out that his/her ID, e-mail, or password has been misused, he/she shall inform Weidong Ferry of such immediately.
      3. 3. The user should comply with the requirements set forth in the related laws and regulations.
    3. Article 3 (Provision of Information)

      With the member’s consent, Weidong Ferry may provide various information that it deems necessary while the member is using the service through e-mail, wired media, or posts, etc.

    4. Article 4 (Posts made by the member)
      1. 1. Weidong Ferry is entitled to delete the contents within the service posted or registered by the user if Weidong Ferry believes such contents fall into any of the following;
        1. 1) If the contents slander or defame a third party or other members.
        2. 2) The contents are in violation of the public order or acceptable social norms.
        3. 3) The contents are believed to be related to criminal activities.
        4. 4) The contents are in violation of the copyright or other rights of a third party.
        5. 5) The contents are in excess of the duration of posting designated by Weidong Ferry.
        6. 6) The contents are believed to be irrelevant to the purpose of the bulletin or contain advertisements.
        7. 7) The contents are otherwise believed to be in violation of the related laws and regulations.
    5. Article 5 (Copyright and Right to Use the Posted Contents)
      1. 1. The rights related to the contents posted in the service are as follows;
        1. 1) The rights and responsibilities related to the posted contents lie with the person who posted them. Weidong Ferry has the right of use for the contents.
        2. 2) The member shall not use the contents for commercial purposes, such as processing and selling the information he/she obtained while using the service. However, if he/she wishes to use the information for non-commercial purposes, he/she may do so upon receiving the consent of Weidong Ferry.
    6. Article 6 (Cessation of the Service Provision)
      1. 1. Weidong Ferry may stop providing the service in any of the following situations;
        1. 1) An unavoidable suspension of the service due to repair works or other works on the equipment used for the service
        2. 2) The backbone communication service provider, set forth in the Acton Electric Communication Business, ceased its electric communication service.
      2. 2. Weidong Ferry is entitled to suspend or limit the services, either in part or in whole, when it experiences difficulties in providing the services normally due to a national emergency, power blackout, breakdown of the service equipment or excessive traffic volume in relation to using the services.
  4. Chapter 4 Responsibilities
    1. Article 1 Obligations of Weidong Ferry
      1. 1. Unless there is an extraordinary situation, Weidong Ferry shall allow the users to start using the services on the initiation date of using the services requested by the user.
      2. 2. Weidong Ferry is obliged to provide the services in a stable and continued manner in accordance with these terms of service.
      3. 3. Weidong Ferry shall not disclose the personal information of the members it obtained in the line of service to a third party without the consent from the member him/herself. However, if there is a request by a government agency in accordance with the related laws and regulations, including the Basic Act on Electric Communication, the information is required for a criminal investigation, there is a request by the Information Communication Ethics Committee, or there are other requests in accordance with the procedures set forth in the related laws and regulations, exceptions may be made.
    2. Article 2 Obligations of a Member
      1. 1. A member shall refrain from the following actions when he/she uses the service.
        1. 1) Misusing the e-mail of other members.
        2. 2) Duplicating, using for publication or broadcasting, or providing the information obtained from the services to a third party, without the prior consent of Weidong Ferry and for other purposes than using the service.
        3. 3) Violating the copyright or other rights of a third party.
        4. 4) Distributing sentences, information, or shapes that are in violation of the public order or acceptable social norms.
        5. 5) Actions that are objectively believed to be connected to a crime.
        6. 6) Other actions in violation of the related laws and regulations.
      2. 2. A member shall abide by these terms of services, service guidelines, and precautions herein.
      3. 3. A member shall abide by the limitations of usage announced by Weidong Ferry in the announcement bulletin or announced separately.
      4. 4. A member shall not engage in sales activities using the service without the prior consent of Weidong Ferry. And, Weidong Ferry shall not take any responsibility for the results of the sales activities of the member who does so in violation of the terms of service.
  5. Chapter 5 Termination of the Contract and Limitations to the Services
    1. Article 1 (Termination of the Services and Limitations to the Services)
      1. 1. If a member wishes to terminate the service contract, the member him/herself may make a request for termination online to Weidong Ferry. In such a case, Weidong Ferry will process the service contact termination request.
      2. 2. Weidong Ferry may terminate the service contract or suspend the access to the services for a designated period of time if the member;
        1. 1) Misuses the ID, e-mail, or password of another member, or;
        2. 2) Obstructs the operation of the service deliberately, or;
        3. 3) Assumed an alias when he/she signed up for the membership, or;
        4. 4) Deliberately distributed the contents that are in violation of the public order or against social norms, or;
        5. 5) Plans to use or uses the service for a purpose that would compromise the interests or safety of the nation and public , or;
        6. 6) Defames or put others at a disadvantage, or;
        7. 7) Otherwise violates the terms of services set forth by Weidong Ferry.
    2. Article 2 (Limitations to the Services and Restoration)
      1. 1. If Weidong Ferry wishes to limit the use of service in accordance with provisions in Article 1 above, the cause, date and time, and other information on such a limitation will be notified to the user or his/her representative via e-mail or other means, unless Weidong Ferry believes that the service should be limited immediately.
      2. 2. In accordance with the provisions in item 1 above, if the member is informed of the limitation to the service, the user or the representative may file an objection to Weidong Ferry if he/she finds the limitation objectionable.
      3. 3. Weidong Ferry may temporarily postpone the suspension of the service until it verifies the objections filed in accordance with the provision in item 2 above. The result of such verification shall be notified to the user or the representative.
      4. 4. Weidong Ferry will withdraw the suspension of services immediately if the cause of suspension is removed during the suspension period.
  6. Chapter 6 Damages, etc.
    1. Article 1 (Damages)
      1. 1. Weidong Ferry shall not take any responsibility whatsoever for the damages suffered by the member in line with the use of the services that are provided free of charge, other than the paid services provided by Weidong Ferry such as the purchase of a product, etc.
      2. 2. Weidong Ferry shall, with regard to the paid services provided by Weidong Ferry, such as the purchase of a product, be liable to any damages suffered by the member and attributable to Weidong Ferry as required by the related laws and regulations.
    2. Article 2 (Waiver)
      1. 1. Weidong Ferry shall not be held responsible for its failure to provide the services due to a natural disaster or other equally uncontrollable circumstances.
      2. 2. Weidong Ferry shall not be held responsible for the disruption of services attributable to the members.
      3. 3. Weidong Ferry shall not be held responsible for any losses of expected income of the members or damages caused by the information obtained as a result of using the service.
      4. 4. Weidong Ferry shall not be held responsible for the reliability or accuracy of the information, data, or facts displayed in the service.
    3. Article 3 (Jurisdiction)

      In the case of any legal disputes or proceedings arising out of the use of the services, the court that has the jurisdiction in the area where Weidong Ferry has its address shall have the jurisdiction over such a case.

[Supplementary Rule] Date of implementation: These terms of services shall be implemented from July 1, 2005.

  1. Article 1 Definitions
    1. 1. The term ‘Weidong Ferry’ refers to Weidong Ferry Co.
    2. 2. Transportation means transporting baggage or passengers for a fee or free of charge.
    3. 3. A transporter herein means the maritime transporter. Transporters are divided into the categories of vessel transporter, who issues the boarding passes and transports the passengers, and performers of other services based on various boarding passes.
    4. 4 The passengers are the persons who are transported by the vessels under the consent of the transporter.
    5. 5. The terms of contract means the terms and conditions of the contract that are provided along with and included as part of the boarding passes and other provisions specified in the terms of use and notification texts.
    6. 6. The boarding pass reference table means the rules and procedures, along with the fares, rates, and fees applied by the company in return for transporting passengers and/or baggage. The boarding pass reference table is deemed a part of the transportation terms and conditions.
    7. 7. The boarding pass is a document in proof of the transportation contract with the passenger, and is also referred to as the "Boarding Pass and the Baggage Receipt Certificate" which is issued to the passenger for the transportation of the baggage. The boarding pass may include boarding coupons, vessel coupons, receipt/boarding pass coupons, etc.
    8. 8. The ‘destination means’ the destination in accordance with the transportation contract. The destination for a round trip shall be the same with the place of departure.
    9. 9. Days shall mean the total number of calendar days including Sundays and public holidays. However, in the case of notifications, the date of notification itself is not to be counted. Further, for calculating validities, the date of issuance of the boarding pass and the starting date of the itinerary are not to be included.
    10. 10. The term ‘normal fare’ shall mean the non-discounted fare set for vessel transportation of passengers not under categories eligible for discounts. If this fare is to be applied, specially limited boarding pass validity and other special conditions are not applied.
    11. 11. The term ‘special fare’ means fares other than the ‘normal fares’.
    12. 12. A toddler means a child under 2, for the purpose of discounts.
    13. 13. A child shall mean a young person of age between 2 and 12 years, for discount.
    14. 14. The boarding closing time means the time specified by the transporter by which the passengers should receive the boarding passes and complete the boarding procedure.
    15. 15. The term ‘damage’ means any damages, including death, injury, loss, or other damages caused during vessel transportation or as a consequence of faulty services provided by the transporter.
    16. 16. Indirect damages mean the damages to be borne by the passengers due to loss or damage of baggage or other provable damages.
    17. 17. ‘Force majeure’ means uncontrollable, special, and unpredictable conditions, which could not be avoided even with all due care and attention. (Traffic conditions or the cancellation of the boarding pass are not included in this category.)
    18. 18. Baggage refers to the items the passengers use or carry with them during travel or the items, suppliers, or other portable goods that travelers use for their comfort or convenience. Unless otherwise specified, the baggage herein shall refer to the check-in baggage and carry-on baggage.
    19. 19. The term ‘check-in baggage’ pertains to the baggage that has been checked in with a valid boarding ticket. Furthermore, it refers to the baggage items that are accepted by the transporter and for which the baggage tags have been issued.
    20. 20. Carry-on baggage is baggage other than the check-in baggage.
    21. 21. Baggage tag is an evidential tag used for identification and transportation of the check-in baggage.
    22. 22. The term ‘baggage receipt’ refers to the receipt issued by the transporter with regard to the check-in baggage. This forms a part of the boarding pass.
  2. Article 2 Application of the Terms and Conditions
    1. Application

      With regard to these transportation terms of service, the announced fare, rate and fee are applicable to all passengers and baggage handled by our company.

    2. Effectiveness

      The transportation of all passengers and baggage are based on valid terms of services and the applicable boarding pass reference table as of the date of departure as per the initial boarding pass.

    3. Changes without notice

      Except as required by the applicable laws, government regulations, orders, and instructions, the fare reference table and these terms of services may be amended without prior notice. However, if such amendments take place after the commencement of the trip, the amendments shall not be applicable to the relevant transportation contract. Article 3 Boarding Passes

  3. Article 3 Boarding Passes
    1. 1. General

      If the passenger fails to pay the applicable fare or honor the credit transaction terms of our company, the company shall not issue the boarding pass and will in no case perform the transportation.

    2. 2. Validity of the boarding pass
      1. A. The boarding pass shall be valid for transportation from the port of departure to the destination port specified in the boarding pass and the applicable class thereto. The pass shall remain valid for the period specified in item B below, provided that the conditions under Item C are met. Each boarding pass shall be valid for a reserved boarding ticket. And, if the boarding pass has been issued without a reserved seat, the reservation can still be made if there are available seats at the time of issuing the boarding pass. The place of issuance and the date of issuance shall appear on the boarding pass.
      2. B. The boarding pass issued as per normal fare shall be valid for one year from the date of initial issuance.
      3. C. The class of reservation on the boarding pass and the class information in the reservation records should match. If the classes mentioned above do not match, the passenger may not be allowed to board the vessel. Alternatively, the passenger can be allowed to board the vessel provided that the fee difference is paid up.
      4. D. A boarding pass for which the validity period has expired shall not be refunded.
    3. 3. The information to be provided on the boarding pass: The boarding passes should include following information.

        3. C. The date of boarding, voyage, class, cabin and seat number (the class, cabin and seat number are only applicable to the passes for designated voyages.)
        4. D. Validity
        5. E. The personal information of the passenger (Name in English, Passport number)
        6. F. Other required information
    4. 4. Extension of the validity of the boarding pass
      1. A. In the following cases, the validity of the boarding passes can be extended beyond 30 days without charging any additional fare.
        1. 1) The company deliberately delayed or canceled the date when availability of the cabin is confirmed during the original validity period.
        2. 2) The company changed the class of the cabin.
        3. 3) The company is not able to provide the cabin which has been confirmed.
      2. B. If a passenger who has a boarding pass that is valid for a year requests a reservation, the validity can be extended for seven days beyond the original validity if the cabin is not available for the dates that the passenger wishes to reserve.
    5. 5. Amendment of the boarding pass

      The boarding pass once issued can be amended by no later than 24 hours before the departure. Group boarding passes cannot be amended except for a case of Force Majeure.

    6. 6. Failure to present the boarding pass, lost board passes, and exceptions

      The company shall refuse to transport a passenger who fails to present his/her valid boarding pass. If the boarding pass has been lost or not presented, transportation shall not be provided unless the passenger purchases a new boarding pass under the valid fare as of the date of travel. If a part of the boarding pass has been damaged, tampered with, or deleted by a person other than the transporter, the company will not accept such a boarding pass. Notwithstanding the above, if there is satisfactory evidence proving the loss and the legitimacy of the evidence is acknowledgeable, the company will issue a new boarding pass. However, in this case, the new boarding pass shall be issued only under the condition that the passenger should agree to indemnify and hold the company harmless for any potential damages to the company due to the issuance of the replacement boarding pass

    7. 7. No assignment
      1. A. A boarding pass cannot be assigned.
      2. B. If the boarding pass is presented by a person other than the passenger who is entitled to receive the transportation service or refund, the company shall not be held responsible for the fact that the transportation service or refund of the booking charges is provided in accordance with the boarding pass toward the person who presents the boarding pass.
  4. Article 4 Fares and fees
    1. 1. Applicable fares and fees
      1. A. Unless otherwise specified in the fare reference table and the terms of service, the fare and fees to apply to the transportation in accordance with the said terms of services and the fare reference table, shall be those legitimately announced by the company and valid as of the date which is specified in the boarding pass or the day when the fare for the travel on the designated course was paid.
      2. B. A request to assign a cabin for a toddler who is accompanied by a passenger who paid the normal fare, or there are two or more, half of the normal fare shall be collected.
      3. C. The fare does not include the meals provided in the cabin.
    2. 2. Payment of the fares and fees
  5. Article 5 Reservation
    1. 1. General

      The boarding pass shall be valid only for the date and course for which the cabin has been booked. If a boarding pass is unused, or the passenger wishes to change the boarding pass or the reservation specified in the boarding pass, such cases shall not be treated as priority in confirming the reservation.

    2. 2. Conditions of reservation
      1. A. The reservation of the cabin for a certain date is valid when the reservation is confirmed by the reservation officer of the company and the record for the confirmed cabin reflects in the reservation system of the company. If the passenger does not purchase the boarding pass of the reserved cabin until the deadline designated by the company, the company will cancel the reservation without further notice.
      2. B. The company cannot guarantee the assignment of a specific cabin within the vessel.
    3. 3. Communication costs

      The communication charges pertaining to any special reservation request by the passenger, including the phone bills, telegram, or radio communication charges, paid by or charged to the company shall be borne by the passenger.

    4. 4. Cancellation of reservation

      If the passenger fails to board the vessel on the confirmed reservation date without prior notice, the company may cancel the one-way or the two-way trip reservations of the passenger.

    5. 5. Personal Information

      If the passenger or the agent of the passenger requests the reservation of a boarding pass or provision of other services, the necessary personal information (name in English, date of birth, passport number, phone number, etc.) should be provided to the company. The information the passenger provided to the company may be submitted to the relevant government institution or organization if the company deems such disclosure necessary to book the boarding pass the passenger requested or provide other services, or when the laws and regulations, orders, or requests of the destination country necessitate disclosure of such personal information.

  6. Article 6 Boarding Procedure and Boarding
    1. 1. Boarding procedure and gate closing time

      The passengers shall complete the cabin assignment and baggage check-in with sufficient time left for departure, so that the immigration and boarding procedures can be completed. The designated time can be different in each port of departure. Therefore, the passengers should be aware of and adhere to the specified time. To ensure a convenient traveling experience, passengers should complete the cabin assignment and baggage check-in with sufficient time left before departure. The company shall notify the designated boarding time to the passengers, and if the passenger does not show up at the boarding gate within the boarding gate closing time, the company has the right to cancel the reservation.

    2. 2. Boarding closing time

      The passenger should arrive at the boarding gate designated at the time of cabin assignment. If the passenger fails to show up by the boarding closing time, the cabin assignment may be canceled.

    3. 3. Responsibility

      The company shall not be responsible for the damages or costs incurred by the passenger due to failure to adhere to the provisions within this section.

  7. Article 7 Refusal of Transportation and Limitations, etc.
    1. 1. The right of refusal

      The company may refuse to transport a passenger or an item of baggage when it reasonably believes that the following have occurred or there is a potential that the following may occur

      1. A. The passenger fails to follow the instructions or requests the company or a government organization for their personal safety and life.
      2. B. For compliance with the applicable laws, rules, or orders or if the passenger has a history of causing disturbance or using violence in the immigration area.
      3. C. The passenger or the baggage may affect the health or safety of other passengers, employees, or crew or significantly influence their comfort of travel.
      4. D. Including the influence of alcohol or drugs, the mental or physical status of the passenger can be harmful or hazardous to the passenger him/herself, other passengers, crew, or assets.
      5. E. The passenger has a history of inappropriate actions and there are sufficient reasons to believe that such behavior can be repeated.
      6. F. The passenger refuses to provide their ID card upon the company’s demand to verify that the passenger is the same person to whom the boarding pass was issued, or the passenger fails to prove his/her identity.
      7. G. The passenger refuses to receive safety inspections on his/her body or baggage.
      8. H. The passenger disposes of, tampers with, or forges traveling documents to enter the destination country or other countries for which the passenger does not have the proper traveling documents, or refuses to submit the traveling documents in order for the company to process the documents such that a certificate is to be issued.
      9. I. The passenger presents a boarding pass that has been illegally obtained, forged, or purchased from other sources than the appropriate agency, or the passenger reports that the boarding pass has been lost or stolen.
    2. 2. Conditional acceptance for transportation
      1. A. The company carries out the transportation under a fare reference table and the relevant rules applicable on the explicit condition that the company shall not be deemed responsible if the passenger's status, age, or mental or physical conditions endanger the passenger him/herself or others. Further, the company shall not be held responsible for the passenger’s diseases, injuries, disability, or worsening of such conditions or other results (including death).
      2. B. Transportation of passengers under the categories of infants under 2 months, unaccompanied child under 5, handicapped persons, pregnant women (32nd week or beyond) or with other special needs for help, can be arranged if the documents required by the specific guidelines of the company are secured and there is an agreement with the company on other necessary actions to be taken. If the passenger informs the company of his/her disability and other special requests for transportation and the company agrees to transport the passenger under such conditions, transportation shall not be denied due to the disability or special requests.
    3. 3. Conduct within the vessel
      1. A. If the passenger commits any of the following offenses, the company may take necessary actions to curtail such actions, including detainment.
        1. 1) Poses threats to the passengers or assets on board.
        2. 2) Does not comply with the legitimate instructions or requests by the crew to stop certain activities (including but not limited to smoking, drinking alcohol, use of drugs)
        3. 3) Causes concern, inconvenience, damages, or injuries to other passengers or crew.
      2. B. The damages resulting from the activities specified in A. above shall be the liability of the passenger entirely.
    4. 4. 4 Boarding limitations

      If an individual who frequently uses our services poses threats to the safety or health of other passengers, crew, or the safety of the voyage, boarding limitations as specified in the appendix may be imposed.

  8. Article 8 Baggage
    1. 1. Baggage
      1. A. The company will feed the number of the check-in baggage to the computer system when it receives the check-in baggage (Upon the issuance of the baggage receipt). Also, the company will issue the baggage tag (claim tag) for each unit of the baggage delivered as above and for which there is a baggage receipt issued.
      2. B. All check-in baggage should be packed in suit cases or other similar containers so that they can be handled and transported safely via typical handling. The company does not accept fragile or perishable materials, currency, jewelry, silverware, securities, other valuable goods, antiques, or documents as check-in baggage.
      3. C. No provisions under these terms of services shall be construed as an acknowledgement of the rights of the passenger to check in the baggage if the transporter cannot provide aids for checking in the baggage.
    2. 2. Transportation of the baggage
      1. A. The check-in baggage should be transported on the same voyage with the passenger whenever possible. If the volume of the cargo does not allow it, the baggage shall be transported through the following voyage.
      2. B. The company shall not respond to requests from the consignor of the baggage for total shipment, half-shipment, landing in the middle of the voyage, retrieval of the contents, etc., except for the cancelation of the entire check-in transportation itself.
      3. D. The company shall, if the passenger requests transportation and then requests the cancellation of the transportation, take actions after checking whether the baggage has been loaded or not. If the baggage is already loaded, it shall be released only at the next port of departure.
    3. 3. Inspection of the baggage

      The company has the right to inspect the contents of the baggage in the presence of the passenger. In case of baggage without accompanying passengers or baggage that falls under the five categories below, the company has the right to open and inspect the baggage regardless of the presence of the passenger. However, the company is not obliged to do so. And, having or exercising such a right shall not be interpreted as the company’s intent to transport baggage which was originally refused.

    4. 4. 4 Claim of the baggage
      1. A. The check-in baggage shall be handed over to the holder of the baggage receipt when all the outstanding payment due to the company is cleared and the baggage claim tag for the relevant baggage is returned to the company. The company is not responsible for checking whether the holder of the baggage receipt and the baggage claim tag is the legitimately entitled person. Furthermore, the company shall not be held responsible for any damages, costs, or loss that are directly or indirectly attributable to not checking it. Except for the conditions under C below, the baggage shall be handed over at the destination which is specified in the baggage receipt.
      2. B. If the holder of the baggage receipt and the baggage claim tag collects the baggage without a written complaint (which should be submitted within the same day), it shall be considered as an evidence that the baggage has been delivered in good condition in accordance with the transportation contract.
      3. C. A claimant of the baggage who did not receive the baggage by the end of the immigration clearance shall prove that he/she is the legitimate owner and the baggage shall be directly delivered by the related organization.
    5. 5. Hazardous materials, fragile materials, or baggage not appropriate for transpiration

      The passenger shall not include material that could endanger the vessel or life or assets of the passengers and crew, fragile materials that can be damaged during the voyage or items that are not packed properly. Passengers are also not allowed to include items that are banned by the laws, regulations, or orders of the destination country in the baggage. The company may refuse to transport the baggage, either in part or in whole, before departure if the size, weight, or characteristics of the baggage are not suitable to be transported by the ship.

      1. 1) Pets accompanied by passengers
      2. 2) Plants or vases carried by the passenger
      3. 3) Electronic appliances (refrigerator, TV, washing machine, etc.)
    6. 6. Allowed volume of free-of-charge baggage
      1. A. With regard to the free-of-charge check-in baggage, the sum of the width, height, and depth of the baggage should not exceed 250cm and the weight shall not exceed 50kg. Up to two such baggage items are allowed per passenger.
      2. B. The company shall refuse to accept baggage in excess of the above and no additional fees will be charged for the check-in baggage.
      3. C. This provision may be amended in accordance with the laws, rules, and orders applicable to the port of departure or destination, or the conditions within the company.
    7. 7. Free carry-on baggage
      1. A. A baggage item that can be carried on into the cabin and stored under the full responsibility of the passenger, for which the sum of the three dimensions does not exceed 150cm and the weight is within 20kg, may be transported in addition to the free-of-charge check-in baggage.
      2. B. Wheel chairs that can fully be folded as well as other orthoses such as crutches, artificial arms, or artificial feet for the use of a handicapped passenger may be carried on into the ship free of charge.
      3. C. On account of related to the operation of the vessel, if carry-on baggage that are otherwise suitable in the light of the regulations cannot be accommodated in the cabins, such carry-on baggage may be stored in the cargo bay and transported. In this case, however, the above baggage shall be considered as check-in baggage.
      4. D. The company may limit the number of persons to be accommodated within the cabin for the carry-on items in accordance with the rules on safety, etc.
  9. Article 9 Voyage Schedules, Delays, and Cancellation
    1. 1. Schedule
      1. A. The schedules given in the time table or other materials are mere plans without guarantees. They do not form a part of the transportation contract. The schedule can be changed without prior notice. Furthermore, the company shall not be held responsible for errors or omission in the time tables or other schedules. No statement or indication by an employee of the company on the date of departure or other issues related to voyages binds the company.
      2. B. When a reservation is made, the company notifies the planned time of voyage, as estimated at the time of making the reservation, to the passenger and also indicates the time on the boarding pass when it is issued. However, even after the boarding pass is issued, the schedule of voyage can be changed. If the passenger has provided his/her contact information to the company, the company will do its best to inform the passenger of the changes. If the schedule is changed after the boarding pass has been paid for and the passenger refuses to accept the changed schedule, the company shall refund the unused boarding passes.
    2. 2. Cancellation
      1. A. The company may not change the transporter or the vessel without prior notice.
      2. B. The company may cancel, abort, change, delay, or postpone the voyage or reservation without notice and decide whether to depart from or enter into a port. In this case, the company shall not take any responsibility other than for refunding fares and fees for the unused boarding passes, in the following circumstances:
        1. 1) An event that is not under the transporter’s control while it is happening, feared to happen, or reported to have happened (including but not limited to weather conditions, Act of God, riot, disturbance, civil unrest, blockade of the port, war, hostile actions, civil wars, or unstable international relationships), or the delays, requests, conditions, events, or instructions which are directly or indirectly attributable to such events.
        2. 2) Events or conditions that are not foreseen, expected, or anticipated.
        3. 3) The government's rules, orders, demands, or instructions.
        4. 4) The lack of man power, fuel, or equipment, difficulties in terms of labor force of the tour operating company or other companies.
      3. If the passenger refuses to pay the fare charged by the company either in part or in whole, the company is entitled to cancel the boarding pass or the round trip voyage for such a passenger. In such a case, the company shall, in accordance with the provisions of these terms of services, not be responsible for any eventualities whatsoever, except for refunding the unused part of the already-paid fares or fees.
  10. Article 10 Refunds
    1. 1. General
      1. A. A request for refund should be filed within the validity period of the boarding pass. The boarding passes that are expired shall not be refunded.
      2. B. A person who requests a refund shall submit the unused coupons of the boarding pass to the company.
      3. C. A refund shall be granted if the boarding pass bears the name of the applicant.
      4. D. In case the purchaser of the boarding pass designates a person to whom the refund should be made in the case of a cancellation, the refund shall be made to such a person.
      5. E. If a refund is made to a person or a company that is indicated on the application for a refund in accordance with this rule, it is a valid refund. Further to this, the company shall not be responsible to refund again to the actually entitled person or the person originally indicated at the time of booking.
      6. F. For boarding passes submitted to government agencies or the company as a token of intent to leave the country, the company may reject to make the refund unless the passenger proves to our satisfaction that he/she is permitted to stay in the country or will leave the country through other transporters or means of transportation.
    2. 2. Currency

      Refunds shall be made at the place where the ticket was first purchased in the currency of the initial payment of the fare.

    3. 3. Refund due to reasons attributable to the passenger
      1. A. The company shall refund the fares after deducting the following if the passenger delays or cancels the boarding at his/her discretion after he/she purchased the boarding pass (including the round-trip passes).

      2. B. The deduction and refund of the fare mentioned above may vary depending on the situation at the place of issuance.
    4. 4. Lost boarding pass
      1. A. Refund for a lost boarding pass shall only be made if the lost boarding pass is not used by another person for transportation, refund, or reissuance. Also, the refund shall only be made if the passenger agrees to defend, indemnify, and hold the company harmless for the damages, losses, claims, or other losses whatsoever resulting from the presentation of the lost boarding pass for transportation, refund, or other uses.
      2. B. If the passenger requesting a refund provides the company with satisfactory evidence of the loss of the ticket, such a request shall be filed using the "Refund Application for a Lost Boarding Pass". The refund shall be made at the place of initial issuance, after making sure whether the ticket has been used by or refunded to another person.
  11. Article 11 Taxes, Fares, and Fees

    The taxes, charges, or fees collected by the government agencies or the operator of the terminal shall be collected in addition to the official fare and fees, taxes, and charges. The passenger shall also pay any newly imposed taxes or charges that are introduced after the issuance of the boarding pass.

  12. Article 12 Immigrations
    1. 1. Compliance with the law

      The passenger shall abide by the laws, regulations, orders, demands, and conditions of travel in force at the destination country and the rules and instructions of the company. The company shall not take responsibility for the oral, written, or other forms of advice or information provided to the passenger by the employees of the company with regard to obtaining the necessary documents or complying with the relevant laws, regulations, orders, demands, or instructions. Also, the company shall not be held responsible for any consequences of the passenger failing to secure the necessary documents, or to comply with the relevant laws, regulations, orders, rules, instructions, requirements, and demands.

    2. 2. Passport and Visa
      1. A. The passenger shall provide the entire travel documents and other documents as required by the laws, rules, orders, or other requirements of the countries he/she is scheduled to visit. The company shall refuse to transport any passenger who fails to comply with such laws, rules, orders, demands, or requirements or does not provide the necessary documents in whole. The company shall not be held responsible for any losses suffered by the passenger for not complying with these rules. In addition, if the passenger inflicts damages to the company due to his/her failure of compliance, the passenger shall compensate the company for such losses or damages.
      2. B. In case the destination country denies entry to the passenger and we are required by the government’s order to send the passenger back to the port of departure, the passenger shall pay the company the applicable fare for the return trip, as governed by the laws or rules. This payment of return trip fare shall be made using the fund paid in advance by the passenger to the company or the passenger's fund held by the company. The fare that was collected for the return trip due to deportation or denial of entry shall not be refunded.
    3. 3. Customs clearance

      The passenger shall cooperate in the inspection of the check-in baggage or the carry-on baggage in accordance with the specifications by the customs office or other government officials. If the passenger fails to comply with these conditions, the company shall not be responsible for the passenger. If the passenger causes damages to the company due to failure on the passenger’s part to comply with the above mentioned conditions, the passenger shall compensate the company for such damages.

    4. 4. Government regulations

      If the company in good faith makes a rational decision to deny transportation to a passenger in pursuance to the laws, government rules, demands, orders, or requirements applicable, the company shall not be held liable for it.

  13. Article 13 Waiver of the Limit of Responsibility of the Transporter and Holding of the Right of Indemnity
    1. 1. For any claims of damages including death, injuries, or damages of any other nature (hereinafter referred to as the 'damages') in the process of transportation by the company, the company shall not be liable unless such damages are proven to be attributable to the negligence or deliberate fault of the company and not to the passenger.
    2. 2. The company shall not be held responsible for the damages on the carry-on baggage unless such damage is proven to be attributable to the company. In case of carrying-on in to the cabin or disembarking the carry-on baggage, the assistance by our staff shall be considered as only gestures of courtesy to the passenger.
    3. 3. The company shall not be held responsible for the damages directly or indirectly attributable to the passenger's non-compliance with the laws or regulations or causes beyond the control of the company, if it is satisfactorily proven that company complied with the laws, government regulations, rules, orders, or other mandatory requirements.
    4. 4 The company shall not be held responsible for the damages actually suffered by the passengers, and all claims on damages should be accompanied by proof of the actual amount of damages.
    5. 5. The company shall not be held responsible for the damages on the baggage if such damage is caused by the contents of the baggage. If a passenger’s belongings cause damages to the baggage of other passengers or assets of the company, the passenger shall compensate for the total loss or costs suffered by the company.
    6. 6. The company shall not be held responsible for any damages, losses, or delay in the delivery of any fragile or perishable materials, currency, jewelry, silverware, securities, other valuables, documents, or samples, regardless of whether the company is aware of the baggage containing such items.
    7. 7. The company may refuse to check-in the items that are not considered as baggage in accordance with these terms of services.
    8. 8. The company shall not be held responsible for any indirect losses or special losses resulting from the applicable boarding pass reference table and these terms of services, regardless of whether the company was aware of them.
  14. Article 14 Expiry of the Claim Rights for Damages and Filing of Lawsuit
    1. 1. Expiry of the claim rights for damages

      No claims for damages on or loss of baggage shall be accepted, unless the person who is entitled to claim the baggage identifies the damage or loss and files a complaint within the same day. All complaints shall be submitted in writing within the same day.

    2. 2. Deadline for filing lawsuits

      Any lawsuits on the responsibility of the company shall be filed within one year from the date of arrival at the destination, the date on which the vessel should have arrived, or the date from which the operation stopped as applicable. The rights to file lawsuits on the responsibility of the company shall expire after the said period.

  15. Article 15 Precedence of the Laws

    If the terms on the boarding pass, these terms of services, or the applicable fare reference table are against the laws, government regulations, orders, or other mandatory requirements, this rule shall be valid within the range that is not in violation of such laws. If any clause is rendered invalid, other clauses are not affected.

(Date of Effectiveness) These terms of service shall take effect starting from December 1, 2006.

    2. ② In this case, Weidong Ferry will not use the privacy information for which there was a request for correction of errors, until such errors are corrected.
    3. ③ If the erroneous information has already been provided to a third party, the correction result will be notified to the third party immediately to make the necessary corrections.
  8. 8. Withdrawal of consent regarding submission, use, and provision of the privacy information in relation to privacy policy (withdrawal from membership)
    1. ① A member can withdraw his/her consent regarding the submission, use, and provision of the privacy information that he/she provided when signing up for membership at any time. The withdraw of consent can be made through the ‘Change the member information’ and taking the relevant steps using the ‘withdrawal from the membership’ menu, or contacting the privacy information management supervisor by letter, e-mail, or phone, etc., upon which we will take the necessary steps including deleting out your privacy information.
    2. ② Weidong Ferry will take the necessary measures to make it easier for you to withdraw your consent (or to withdraw from membership) than for us to gather such information.
  9. 9. Storage and Disposal of the Privacy Information
    1. ① While you receive the services provided by Weidong Ferry as a member of Weidong Ferry, your privacy information will be kept by Weidong Ferry and used for providing such services.
    2. ② If a member of Weidong Ferry deletes his/her ID or makes a request to withdraw from membership in accordance with Article 8 ‘Withdrawal of consent regarding submission, use, and provision of the privacy information in relation to the privacy policy (withdrawal from the membership)’ above, your information will be deleted from our hard disc in an irrevocable manner, so that the information will never be accessible or usable again, unless preservation of such information is required by related laws or regulations.
  10. 10. Technical and Managerial Measures to Protect the Privacy Information
    1. 1) Technical measures
      1. ① Weidong Ferry will, in order to prevent leakage of your privacy information by hacking attacks, etc., use devices that will prevent attacks or infiltration from outside. And, we have installed an infiltration detection system to monitor the system for any infiltration 24 hours a day.
      2. ② Weidong Ferry has implemented anti-virus software and encryption algorithm for transmitting the privacy information over the network to protect your privacy information.
      3. ③ In the case of other damages to the privacy information of the members, Weidong Ferry is backing up the system and the data in preparation for any unexpected incidents.
      4. ④ The computer rooms and the archival rooms of the company have been established as a special protection area, to which access is controlled.
    2. 2) Managerial Measures
      1. ① Weidong Ferry has minimized the number of managers and limits access to the privacy information by the employees in order to protect the privacy information. And, we manage the passwords of the administrators with the utmost care. The limited number of personnel who are allowed to access the privacy information are as follows;
        The persons who perform marketing tasks directly in contact with the users
        The privacy information management supervisors, management officers, and other persons who manage the privacy information
        The persons who are required to handle the privacy information due to the nature of their work
      2. ② The employees of emission trading system will not disclose or provide the privacy information of the members that they came across in the course of their duties.
      3. ③ Weidong Ferry will use any possible means to authenticate the identity of users when handling the privacy information due to requests for passwords made by the users themselves, etc., and will do its best to ensure the information is handled safely.
      4. ④ Weidong Ferry provides regular internal training and commissioned outside training to the employees who handle the privacy information so that they can obtain new security skills and be reminded of their duties to protect the privacy information.
      5. ⑤ When we recruit new employees, we have them sign a declaration not to leak the privacy information. And, we also have established internal procedures to monitor the employees’ performance of and compliance with the requirements regarding the privacy information.
      6. ⑥ The changing of personnel who are involved in the handling of privacy information is conducted with security measures in place. And, responsibility for any incidents involving the privacy information after newly joining the company or resigning from it is made clear.
      7. ⑦ Weidong Ferry will not take any responsibility for the consequences of the personal mistakes of the users or the fundamental risks associated with the Internet. In order to protect the privacy information of the users, you need to manage your IDs and passwords properly and be responsible about them.
      8. ⑧ If it is found out that the privacy information has been leaked, tampered with, lost, or damaged due to the mistakes of the administrator or accidents related to the technical management, the ‘mall’ will inform you immediately and seek to put in place appropriate measures and remedies .
      9. ⑨ We store the privacy information and the normal data separately in different servers, and the two are not commingled.

    Weidong Ferry can provide the users with the links to websites or data of other companies. Since Weidong Ferry does not have any control over other such websites or the data in them, Weidong Ferry does not assume any responsibility or provide any warranty on the usefulness of the services or data provided by other such websites.     1. 1) Weidong Ferry values the posts made by the members and will protect them from tampering, damages, or deletion through its best efforts, except for the following;
      1. ① Spams (ex: Letter of Luck, 800 Million Letters, advertisement of a specific website, etc.)
      2. ② Defaming or slandering posts, spreading false information to defame other people.
      3. ③ Disclosing personal information of others without consent
      4. ④ Contents that are in violation of the copyright of Weidong Ferry, the third-party copyrights, or other rights
      5. ⑤ Posts that are not related to the themes of the bulletin
    2. 2) Fundamentally, the overall rights and responsibilities of the posts are with the composer of the content. Also, since it is difficult to have the information that is voluntarily disclosed protected, we advise you to use caution before disclosing such information.
  13. 13. Protection of the Privacy Information of Children
    Weidong Ferry has implemented following mechanisms in order to provide the privacy information of children under 14;
    1. ① Children under 14 are required to use a separate form to sign up for the membership. And, we request them to provide the consent of a legal guardian when collecting their privacy information.
    2. ② The consent will be made by entering the name, resident registration number, and contact information of the legal guardian, as well as other procedures set forth in the ‘Privacy Information Protection Guideline’ announced by the Ministry of Information and Communication.
    3. ③ The legal guardian of children under 14 may demand access to, correction, or deletion of the privacy information of the children. The ‘mall’ will take the necessary measures immediately upon such a request.
    4. ④ Weidong Ferry will not provide the privacy information of children under 14 or share such information with third parties.
    5. ⑤ If the legal guardians of children under 14 demand corrections of the errors in the privacy information gathered from children, the use and provision of such privacy information will be prohibited until such errors are corrected.
    6. ⑥ We will not send advertisement materials or proposals to the users indicated as children being under 14 or entice them to disclose more information by means of games, gifts, or events.
  14. 14. Rights and Obligations of the Members
    1. ① We need you to update your privacy information and keep it up to date, in order to prevent unexpected incidents. The responsibility for any incidents resulting from incorrect privacy information provided by the members will be with the members themselves. You may lose your membership if you provided us with false privacy information or the privacy information of others.
    2. ② You have the right to have your privacy information protected, as well as the obligation not to violate the information of others. Use caution to protect your privacy information, including the passwords, and be careful not to damage the personal information of others including their posts. If you fail to fulfill such responsibilities and compromise other people’s information or dignity, you may face punishment in accordance with the Act on Promotion of Information and Communications Network Utilization And Information Protection.
